Terms and Conditions (T&Cs)

for the QRS PUR online shop
of 5Star MV GmbH

1. Scope of Application

These General Terms and Conditions (hereinafter "T&Cs") apply to all orders, deliveries, and services concluded via the QRS PUR online shop.

The operator of the online shop and contracting party is:

QRS PUR is an online shop and brand presence operated by 5Star MV GmbH for the sale and brokerage of QRS products.

5Star MV GmbH acts as a distribution partner and intermediary for the products offered, not as a manufacturer.

These T&Cs apply to customers resident in Switzerland and in countries of the European Union (EU).

By using the online shop or placing an order, customers agree to these T&Cs.

Deviating terms and conditions of the customer shall not apply unless their validity has been expressly agreed to in writing.

The responsibility for manufacturing, product safety, technical conformity, product labeling, warranty conditions, and regulatory requirements lies with the respective manufacturer or the responsible body.

5Star MV GmbH is neither the manufacturer nor the medically responsible body for the products offered.

4. Products and Services Offered

The QRS PUR online shop offers QRS brand products, in particular:

  • QRS 101 HomeSystem
  • Glasses applicator
  • Ear applicator
  • Rod applicator
  • supplementary accessories

The presentation of products in the online shop does not constitute a legally binding offer, but an non-binding invitation to order.

Product images, technical specifications, colors, packaging and descriptions are for illustrative purposes and may differ slightly from the actual product.

Changes by the manufacturer are reserved.

5. Conclusion of Contract

The presentation of the products in the online shop does not constitute a binding offer.

By submitting an order using the button "Buy now", "Order with obligation to pay" or a similar function, customers submit a binding offer to purchase the selected products.

After receipt of the order, a confirmation will be sent automatically by email. This does not yet constitute acceptance of the purchase contract.

A contract is only concluded by:

  • explicit order confirmation from 5Star MV GmbH, or
  • dispatch of the goods.

5Star MV GmbH reserves the right to refuse orders without stating reasons, particularly in cases of:

  • suspicion of misuse,
  • incomplete or incorrect information,
  • lack of payment authorization.

6. Prices and Payment Terms

All prices are in the currency shown in the shop.

Unless otherwise stated, prices include legally owed value-added tax, but exclude shipping costs and any customs duties or import fees outside Switzerland.

For deliveries to EU countries, additional national fees, import VAT or customs costs may apply, which must be borne by the customer.

The price published at the time of the order applies.

The following payment methods may be offered:

  • other payment methods available at checkout

Payment is due immediately upon conclusion of the contract.

7. Shipping and Delivery

Delivery takes place in Switzerland and selected countries of the European Union (EU).

Deliveries within Switzerland

Orders from customers with a delivery address in Switzerland are generally delivered or organized by 5Star MV GmbH.

Deliveries within the EU

Orders from European Union countries may be delivered directly by the manufacturer QRS International AG or by shipping partners commissioned by them.

Delivery times are non-binding guidelines.

Delays due to force majeure, customs clearance, delivery bottlenecks or shipping service providers do not give rise to claims for damages.

The customer is obliged to check the goods immediately upon receipt and to report obvious defects within 5 working days in writing.

8. Returns, Revocation and Refunds

8.1 Voluntary right of return (Switzerland)

For orders within Switzerland, 5Star MV GmbH grants a voluntary right of return of 14 days from receipt of the goods.

A prerequisite for a return is that:

  • the goods are unused, unopened and in their original packaging,
  • the goods are in the same condition as when they were delivered,
  • proof of purchase is provided.

For reasons of health and hygiene protection, opened or used products are excluded from return.

The costs of return shipment are generally borne by the customer, unless otherwise agreed.

Unannounced returns cannot be accepted.

8.2 Statutory right of withdrawal for customers in the European Union (EU)

For consumers residing in a Member State of the European Union, the statutory right of withdrawal also applies in accordance with the applicable consumer protection provisions.

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period is 14 days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods.

To exercise your right of withdrawal, you must inform us of your decision by means of a clear statement.

To comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the period.

Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse you for all payments we have received from you, including standard delivery costs (with the exception of additional costs resulting from your choice of a different type of delivery), without undue delay and at the latest within 14 days from receipt of the withdrawal.

For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise.

We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods.

The goods must be returned immediately and no later than 14 days after the declaration of withdrawal.

The customer bears the direct costs of returning the goods.

Exclusion or Expiry of the Right of Withdrawal

The right of withdrawal does not exist or may expire prematurely for:

  • sealed products that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery;
  • products that have already been used or opened;
  • individually manufactured or personalized products.

9. Warranty, Guarantee, and Defect Rights

The products offered via the QRS PUR online shop are manufactured by QRS International AG, Franz-Josef-Fürst-Strasse 5, 9490 Vaduz, Liechtenstein.

5Star MV GmbH is exclusively a distribution partner and intermediary for the products offered and does not assume its own manufacturer's warranty.

Manufacturer's Warranty

Any warranty claims are exclusively governed by the warranty conditions of the manufacturer QRS International AG.

If provided by the manufacturer, the manufacturer's warranty is 24 months (2 years) from the date of purchase.

5Star MV GmbH supports customers to a reasonable extent in communicating and processing legitimate warranty claims, but does not assume any independent warranty obligation.

Damage resulting from the following is excluded from the warranty:

  • improper use or storage,
  • external influences (e.g., moisture, falls, overvoltage),
  • natural wear and tear,
  • unauthorised repairs or modifications,
  • disregard of manufacturer's instructions.

Guarantee

The statutory guarantee is governed by the applicable legal provisions.

Obvious defects must be reported in writing within 5 working days of receipt of the goods.

Failure to report defects may lead to the loss of claims, to the extent permitted by law.

10. Liability

5Star MV GmbH is liable exclusively for damages caused by intentional or grossly negligent conduct.

Liability for slight negligence is excluded – as far as legally permissible.

The liability of 5Star MV GmbH is limited to the proper mediation, sales processing and – where applicable – organization of delivery within Switzerland.

In particular, 5Star MV GmbH assumes no liability for:

  • product properties or product effects,
  • technical functionality of the products,
  • medical or health claims of the manufacturer,
  • manufacturer's information, product information or advertising statements,
  • delivery delays outside the control of 5Star MV GmbH,
  • damages resulting from improper use of the products.

The responsibility for manufacturing, product safety, technical conformity and regulatory requirements lies with the respective manufacturer or the responsible body.

Mandatory liability under applicable product liability law remains reserved.

11. Health Notice / Disclaimer for Product Information

The information provided via the QRS PUR online shop, product documents, or other communication channels is for general informational purposes only.

All information regarding products, applications, technical properties, or possible areas of use is based on information from the manufacturer QRS International AG.

5Star MV GmbH does not guarantee the completeness, up-to-dateness, or scientific/medical accuracy of such information.

The products offered do not replace medical advice, diagnosis, or treatment.

No promises of healing are made.

In case of health complaints, existing illnesses, implants (e.g., pacemakers), pregnancy, or uncertainties, it is recommended to consult a qualified medical professional before use.

The use of the products is at one's own responsibility.

12. Data Protection

The protection of personal data is important to 5Star MV GmbH.

The processing of personal data is carried out in accordance with the Swiss Data Protection Act (DSG) and – where applicable – the relevant data protection regulations of the European Union.

For the technical provision of the online shop, 5Star MV GmbH uses the Shopify platform. Personal data may be technically transferred to Shopify or affiliated service providers if necessary.

13. Online Dispute Resolution (ODR) - Note for EU Customers

The European Commission provides a platform for online dispute resolution (ODR), which can be accessed via the following link:

5Star MV GmbH is not obliged and not willing to participate in a dispute resolution procedure before a consumer arbitration board. Consumers from the EU can nevertheless use the platform for out-of-court dispute resolution.

14. Intellectual Property

All content of the QRS PUR online shop, in particular texts, logos, product names, images, videos, graphics and designs, are protected by copyright.

Trademarks, product names and manufacturer identifications of the offered products remain the property of the respective rights holders, in particular QRS International AG.

Any use, reproduction, processing or publication outside of the legally permitted use requires the prior written consent of the respective rights holder.

15. Permitted Use of the Online Shop

The online shop may only be used for lawful purposes.

The following are particularly prohibited:

  • abusive orders,
  • interference with technical systems,
  • distribution of malware,
  • manipulation of prices or content,
  • abusive use of automated systems or bots,
  • violations of applicable law.

5Star MV GmbH reserves the right to refuse orders or block user accounts if misuse is suspected.

16. Force Majeure

5Star MV GmbH shall not be liable for delays or non-performance of services due to circumstances beyond its control.

This includes, in particular:

  • natural events,
  • pandemics,
  • war,
  • official orders,
  • customs delays,
  • supply bottlenecks at the manufacturer,
  • failures of transport or shipping service providers.

17. Place of Jurisdiction and Applicable Law

These General Terms and Conditions are exclusively subject to Swiss law, to the exclusion of conflict of law provisions.

The place of jurisdiction is – to the extent legally permissible – the registered office of 5Star MV GmbH in Switzerland.

For customers from Member States of the European Union, mandatory consumer protection provisions of the respective country of residence remain reserved.

18. Severability Clause

Should individual provisions of these T&Cs be or become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.

The invalid provision shall be replaced by a legally permissible provision that comes as close as possible to the economic purpose of the original provision.

19. Amendments to the T&Cs

5Star MV GmbH reserves the right to amend these General Terms and Conditions at any time.

The version valid at the time of the order shall apply.

The current version is available at any time in the online shop.
